These Terms of Service ("Terms") govern your use of the mymodel platform, website, and services (collectively, the "Service") operated by myModel, Inc. ("myModel," "we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Plain English: These Terms apply to everyone who visits our site or uses our platform — whether you're a consumer joining the waitlist or a brand exploring a partnership. Read them. They matter.
1. Who We Are and What We Do
myModel is a consent-based data marketplace. We give consumers a Stats Card — a live digital profile of their consumer behavior that they own and control. Brands pay consumers directly for permission to access that profile for a defined period. myModel facilitates the transaction. We do not sell your data. We do not collect it on your behalf and resell it. You are the seller. You decide when, to whom, and at what price.
2. Eligibility
You must be at least 18 years old to use the Service. By using myModel, you represent and warrant that:
- You are 18 years of age or older
- You have the legal capacity to enter into a binding agreement
- You are not prohibited from using the Service under any applicable law
- The information you provide is accurate and complete
myModel is not directed to children under 13. If we learn that a user under 13 has provided personal information, we will delete it promptly.
3. Accounts and Registration
During the current waitlist phase, access to the full platform is invitation-only. By submitting your information to the waitlist, you are expressing interest — not creating a full account. We will contact you when access becomes available.
When accounts are available, you are responsible for:
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized use at [email protected]
4. The Stats Card
Your Stats Card is a live representation of your consumer behavior, generated from data sources you connect to myModel (such as Gmail). You own your Stats Card. myModel does not own the underlying data. We provide the infrastructure to build it, display it, and make it available to brands you approve.
By connecting a data source (e.g., Gmail), you grant myModel a limited, revocable license to process that data for the sole purpose of generating and updating your Stats Card. We do not read, store, or use the content of your emails for any purpose other than building your Stats Card.
5. How Offers Work
When a brand wants to access your Stats Card, you will receive an offer notification. The minimum offer amount is $5.00. You are under no obligation to accept any offer.
If you accept an offer:
- The brand receives read-only access to your Stats Card for 30 days
- Access automatically expires at the end of the 30-day window
- You are paid the agreed offer amount directly
- You may not revoke access mid-term after accepting, but access does not renew without a new offer and your new acceptance
Brands may not contact you directly, spam you, track your activity across the internet, or share your Stats Card data with third parties. These are hard platform rules, not suggestions. Brands who violate them are removed.
6. Payments
myModel will facilitate payment to consumers when offer access is granted. Payment terms, methods, and timing will be specified in the platform at the time of offer acceptance. myModel reserves the right to deduct applicable fees or taxes as required by law.
We are not responsible for payment disputes arising from incorrect payment information you provide. Payments are final once processed unless myModel determines an error occurred.
7. Brand Partner Terms
Brands accessing the myModel platform agree to additional terms set forth in their Brand Partner Agreement. The following restrictions apply to all brands at all times, without exception:
- No direct consumer contact. Brands may not use Stats Card data to contact consumers outside the myModel platform.
- No re-sharing. Brands may not share, sell, transfer, or sublicense Stats Card data to any third party.
- No cross-site tracking. Brands may not use Stats Card data to track consumer activity outside of the access window.
- 30-day limit. Access expires automatically. Brands may not attempt to retain, copy, or extend access beyond the agreed window.
- Permitted use only. Stats Card data may only be used for audience targeting, campaign planning, and related internal marketing purposes.
Violation of brand access rules results in immediate termination, forfeiture of fees paid, and potential legal action. These are not negotiable terms.
8. Prohibited Conduct
You may not use the Service to:
- Provide false, misleading, or fraudulent information
- Impersonate another person or entity
- Circumvent, disable, or interfere with security features of the Service
- Scrape, crawl, or extract data from the platform without written permission
- Attempt to access another user's account or Stats Card without authorization
- Use the platform for any unlawful purpose or in violation of any applicable law
- Transmit spam, malware, or any other harmful content
- Reverse engineer or attempt to extract source code from the Service
9. Intellectual Property
The myModel platform, including its design, software, brand, trademarks, and content created by myModel, is owned by myModel, Inc. and protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without written permission.
Your Stats Card data belongs to you. You grant myModel a limited license to process and display it as described in Section 4. You retain all ownership rights to your underlying personal data.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you agree to the collection and use of data as described in our Privacy Policy.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. myModel does not warrant that the Service will be uninterrupted, error-free, or completely secure.
myModel does not guarantee any specific offer amounts, number of offers, or earnings from participation. Offer availability depends on brand demand, which varies over time.
12. Limitation of Liability
To the maximum extent permitted by applicable law, myModel, Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost earnings, lost data, or loss of goodwill — arising out of or in connection with your use of the Service.
Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the greater of (a) $100 or (b) the amount myModel has paid to you in the 90 days preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless myModel, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.
14. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our discretion. You may stop using the Service at any time.
Upon termination, your right to access the Service ends immediately. Sections that by their nature should survive termination (including Sections 9, 11, 12, 13, and 15) will survive.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction in those courts.
For any dispute, you agree to first contact us at [email protected] and attempt to resolve the matter informally before initiating any legal proceeding.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. For material changes, we will provide additional notice (such as an email or in-platform notification) where feasible. Your continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.
17. Miscellaneous
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. These Terms constitute the entire agreement between you and myModel regarding the Service.
